Re: A Crime Victim’s plea for help!!!
Dear Mr. Spitzer:
The week of April 10th was “Crime Victims’ Week” and you wrote an excellent piece -go here; “Justice, Justice We Shall Pursue” that you delivered to the 20th annual Citywide Crime Victims’ Rights Candle Light Vigil.
Your letter to Honorable Steven Lungen of the Sullivan County District Attorney’s Office dated January 25, 2005 (to me dated July 31,2000)
-go here; (Exhibit #1) is attached hereto and made a part hereof as if set forth at length.
To date, Mr. Lungen has refused to acknowledge or otherwise do anything about the crime committed against me even though you requested his review and that he take whatever “action” he “deem necessary.” Must I assume that Mr. Lungen does not believe that an attempt on my life (neighbor shooting at me) is worthy of his time and trouble to prosecute?
If Mr. Lungen doesn’t have the time or inclination to investigate or prosecute, might I suggest that he give your office jurisdiction to investigate this commission of an indictable offense.
If Mr. Lungen still prefers to avoid and evade his mandated responsibility, I will request that the governor appoint your office to supersede the District Attorney to perform all duties in respect of such action, which the district attorney would otherwise be authorized and required to perform.
It is absolutely bizarre that the local authorities tell me to consult with an attorney; yet, lawyers claim they have nothing to do with what the District Attorney’s office should be investigating.
On my first visit to District Attorney, Stephen Lungen, he informed me: “Before I get pissed off, I want to talk to your lawyer”.
On other occasions when I tried to get some information from Mr. Stephen Lungen to find out what is going on, Mr Lungen told me: "If you don't stop bothering me I am going to lock you up”. To this day I have received no information whatsoever, regarding the assassination attempt on my life, neither from District Attorney Stephen F Lungen, nor from anyone in his office.
Enclosed information and documents, including subpoenaed documents -go here; (Exhibit #2), will help to explain my very real concerns regarding this matter.
Local authorities have thrown me in jail many times with no good cause, and have called me filthy names in addition to the label "communist."
Sir! I fled Poland to avoid communist oppression many years ago. And . . . might I ask what if I was a communist? Aren’t I entitled to the same protections as any other person residing in this country?
It took several years for me to obtain the information and documents, which are enclosed. I had asked for them many times but was told each time that they did not exist or that the case had gone away.
I also received a subpoena to testify before a Grand Jury about how my neighbor, James D'Ambrose, a friend and crony of local authorities, had shot at me.
The Grand Jury investigation never happened, and I was never asked to testify about what happened at all. -go here; (Exhibit #3)
In the meantime I sent again, again, again, again a letters to the District Attorney's office.-go here; (Exhibit #4)
About one year later I received a similarly harassing letter from James D'Ambrose’s lawyer, Henri Shawn.For your information: Stephen Lungen and Henri Shawn used to work together in the office of District Attorney of Sullivan County.
D'Ambrose had been harassing me for years by filing fraudulent complaints against me.
This problem continues to persist until now.
These frivolous complaints were always dismissed, but because of them I was often thrown into jail and my civil rights were violated. After suffering nine years of harassment and persecution with no help from any officials, James D’Ambrose tried to kill me with his shotgun.
The enclosed papers were filed against D’Ambrose for attempting to murder me and other felonies and misdemeanors.
If the felony or attempted murder charges cannot be instituted, I would like to know the circumstances regarding this very dangerous man, a friend of the local legal authorities, was allowed to get away with attempted murder with only a slap on the hand, and with no testimony or other input from me.
I especially think this should happen for the following reason:
D'Ambrose did not just "shoot within 500 feet of a dwelling." He shot directly toward me with 12 gage shotgun and, even according to the information, penetrated the front tire of my tractor less than three feet from where I was sitting, putting me in grave risk of death.-go here; (Exhibit 2),
The investigator who signed this most serious information, Geoffrey Cabrera, told me that D'Ambrose admitted to trying to kill me.
Cabrera asked D'Ambrose why he did this, and D'Ambrose gave him "twenty reasons" why he tried to kill me.
I think Cabrera would testify about this and can help put a very dangerous man in jail, where he belongs.
I do not think that the people are protected when very serious charges are dismissed or ignored.
If you cannot do this, please help me understand how this can happen in a society where local authorities should protect even immigrants like me, and even against their friends and cronies.
It is my humble opinion that the criminal charges from May 2004 have been dismissed.
